Federal Judge María Isabel Bernal intervened in the case of some of the amparos filed by businessmen against the amendments to the Regulations of the Federal Law on Games and Sweepstakes (LFJS), and last Tuesday, July 9, issued a ruling declaring the prohibition of machines unconstitutional.
 
It should be noted that last month, federal judge Gabriel Regis, who also took care of several of the amparos filed by the companies, had already issued a similar ruling. Regis and Bernal concentrate the approximately 60 demands promoted nationwide by the licensees of casinos and their operators
 
Bernal not only ruled against the prohibition of slot machines, but also determined that card games and roulette should also be allowed, since they can also be considered as "draws".
 
"The card games do enjoy the main characteristic of the draws, this is that the final result of them is entrusted to luck, and not exclusively to the skill of the player," Bernal explained.
 
As for the dice, the law itself expressly allows them, so the Executive could not prohibit them in the regulations either, and the judge recalled that cards, roulette and dice can be authorized by the Ministry of the Interior for regional fairs.
 
The new regulation promoted by the Mexican Executive absolutely prohibits "number draws", an understatement for slots, and only authorizes their operation in 444 casinos that operated at the end of 2023, until their permits expire
