The Atlanta-headquartered fantasy sports operator said it will launch its offering in New York in the coming weeks, marking its return after a more than 18-month absence.
The approval follows a legal settlement with the New York State Gaming Commission (NYSGC) in early 2024, in which the business agreed to pay back revenue generated by its prohibited activities between 2019 and 2023.
This followed the NYSGC in October 2023 putting in place a regulation that banned prop-style fantasy contests.
Mike Ybarra, PrizePicks chief executive, said: “New York is home to some of the most passionate sports fans in the country, and we know they will be excited to have PrizePicks back. We’re thrilled to offer a great entertainment experience that elevates how they engage on game day and beyond.”
New York becomes the 16th jurisdiction to formally recognise that PrizePicks’ contests can be offered as games of skill under its fantasy sports laws, the company said in a press release.
PrizePicks says new P2P offering compliant
The operator said it had worked with state gaming regulators to ensure its new peer-to-peer contests comply with New York’s fantasy sports requirements.
Jason Barclay, head of public policy and chief legal officer at PrizePicks, added: “We want to thank the New York State Gaming Commission for their collaboration and recognition of our peer-to-peer offering as a fantasy sports contest.
“We worked diligently to design a game that meets the Commission’s rigorous standards, and New York’s decision underscores the idea that innovation in fantasy sports can thrive within a clear regulatory framework.”
While PrizePicks’ DFS 2.0 rival Underdog was also ordered to leave New York due to the regulator’s rules, the operator returned in May, although neither the against-the-house or peer-to-peer versions of its pick’em games were included under the terms of its temporary licence.
